This is a slightly abbreviated version of a paper delivered at a meeting of the Catholic lay association Witness, in Toronto, onward May 17, 2003. Part I appeared in the July/August edition, pages 34-40 It proffered the position that Judge MacKinnon sined in intervening in the case between Marc Hall and the Durham Catholic seminary Board because civil courts should/must decline jurisdiction from one side of to the other internal Church affairs.
